Matter of M.S. (M.H.)

New York Court of Appeals · NY · United States · · 2026 NY Slip Op 00825 · No. 7

ExcludedAlleged deepfakevideooffered by petitionerchallenge: authenticitysensitive matter — ruling only

Erie County relied entirely on hacked home-surveillance videos in child-protection proceedings. The Court of Appeals held the provenance, chain-of-custody gap, and lack of testimony from the camera operator or hacker made the foundation insufficient, excluding the videos and dismissing the petitions.

Rules cited: People v. Patterson · People v. Price · Family Court Act article 10

The court's finding, in its words
