Shawnee County District Court requires both verification and disclosure. Any filer who used generative AI for any portion of a pleading must check the output for accuracy against print reporters or traditional databases and must state on the first page, in writing, that the document contains AI-generated content, with a certification of the accuracy check. Sanctions may follow a violation.

What the document requires

  • Applies where any portion of a pleading or other paper was drafted using generative AI, naming ChatGPT, Harvey.AI and Google Bard as examples
  • Filer must verify that any generated language, materials or content was checked for accuracy using print reporters, traditional legal databases or other reliable means
  • Filer must disclose to the court and opposing parties at the time of filing, in writing and clearly marked on the first page, that the document contains AI-generated content
  • The disclosure must include a certification that the content was checked for accuracy as required by the rule
  • AI systems may not be factually or legally trustworthy sources of information without human verification
  • Violation may subject attorneys and self-represented litigants to sanctions
