Universal. Every Australian instrument imposes a personal duty to verify citations and evidence references. NCAT PD 7 and Victoria's SC GEN 25 add that verification must not be carried out with another AI tool. Western Australia's guidelines require a human who takes legal responsibility for the document.

Courts enforce this through bad-faith fines.

BRAK KI-Leitfaden §2.1 grounds the duty in § 43 sentence 1 BRAO (gewissenhafte Berufsausübung) and the principle of personal performance (§ 613 BGB): AI may only support, never replace, and 'eine eigenverantwortliche Überprüfung und Endkontrolle der KI-Ergebnisse' is required in every case. KG Berlin (20 Nov 2025, 17 WF 144/25) held counsel must check whether citations come from a 'fantasising' AI.

New Zealand

It warns that an AI cannot verify its own output, and names hallucinations, missing/outdated training data and sycophancy — an AI adapting its answer to the user's view — as the error sources. §2.3: a lawyer cannot plead that 'the AI made a mistake'.

For judges, article 17 of the ethics code requires independent verification.

China

Beijing Tongzhou District People's Court, selected for the People's Court Case Database in December 2025: a lawyer filed two AI-fabricated precedents; the court wrote criticism into the judgment and stated that litigants submitting unverified AI-generated cases bear consequences, from criticism to fines under Civil Procedure Law article 114 in serious cases.

Colombia

The Supreme Court's civil cassation chamber fined a lawyer 15 minimum monthly wages for a review petition citing ten non-existent rulings generated by AI, and the Council of State held in June 2026 that all AI output must be humanly verified and lawyers remain fully responsible. For judges, Acuerdo PCSJA24-12243 article 9 is binding.

Denmark

Kerala and Gujarat High Court policies impose verification on judicial officers.

Tribunale di Firenze (14 March 2025) censured the failure to verify ChatGPT citations; Tribunale di Siracusa (20 February 2026) treated unverified generative-AI output as gross negligence; the Cassazione declared a petition inadmissible for probable hallucination.

Kenya

Mwamuye J (Milimani High Court, Mar 2026) held computer-generated documents or outputs of artificial intelligence cannot substitute for human-drawn documents; Chigiti J (16 Apr 2026) set aside a judgment founded on AI-generated pleadings. Supreme Court Justice Lenaola warned in May 2025 that every authority in one submission was fictitious.

The Guimaraes Court of Appeal on 10 February 2026 called citing six non-existent appellate and Supreme Court rulings absolutely inadmissible, stressed higher standards for legal professionals and suggested referral to the bar.
