What the document requires

  • Recommendations 1–11 form a procurement checklist: purpose, data entering the tool, which contract applies, supplier confidentiality commitments, IP and indemnity terms, GDPR role, security measures, integration and fine-tuning.
  • Recommendation 12: review client engagement terms for restrictions on AI use.
  • Recommendation 13: identify when the client must be informed, including Article 50 AI Act duties.
  • Recommendation 14: identify when client consent is needed, given risks such as hallucination.
  • Recommendation 15: assess when AI use should affect the client's fee under fixed-fee versus hourly arrangements.
  • Recommendations 16–21: internal AI policies, training under Article 4 of the AI Act, regular reassessment and prompt management; Recommendation 22 covers incident management.
