Rule 1.17 requires that where generative AI has been used in drafting any document filed in the Oklahoma Court of Criminal Appeals, the party or counsel must ensure every AI-produced or AI-modified portion has been verified as accurate by a person responsible for the document. Non-compliance may lead to waiver, striking of the document, or contempt.

What the document requires

  • Applies to any document filed in the Oklahoma Court of Criminal Appeals
  • Where generative AI has been used, every portion produced or modified by it must be verified as accurate by a person responsible for the document
  • Generative AI is defined as any type of AI that generates content or data in response to a prompt or query by a user
  • Failure to comply may result in waiver of the affected issue(s) on appeal, striking of the non-compliant document from the record, and/or a finding of contempt
