What the document requires
- Para 2.3.1: legal representatives, litigants in person and those assisting them must take reasonable care when using AI tools to draft pleadings, witness statements and skeleton arguments, particularly over citations, legal propositions and facts.
- Para 2.3.2: failure to take reasonable care may result in costs sanctions, strike-out, referral to a professional regulator, contempt proceedings or referral to the police (citing R (Ayinde) v Haringey [2025] EWHC 1383 (Admin)).
- Para 2.3.3: documents produced with AI tools remain subject to page limits and should not include irrelevant material.
- Para 20.2.5: authorities cited in skeleton arguments must be genuine; AI-generated authorities must not be relied on without checking the source directly.
