Section 1.6 of the Technology and Construction Court Guide 2026, published 1 July 2026, lets legal representatives in England and Wales use AI if they remain responsible for accuracy. Any doubt about whether to mention AI use must be resolved in favour of disclosure; confidentiality must be protected; AI-assisted research and citations must be independently verified.

What the document requires

  • Para 1.6.1: legal representatives are personally responsible for the accuracy of material put before the court; on that basis AI can be used.
  • Para 1.6.2: whether to disclose AI use depends on context, but any doubt must be resolved in favour of disclosing it.
  • Para 1.6.3: representatives must uphold confidentiality and protect the privacy of any underlying data used with AI.
  • Para 1.6.4: AI-assisted research and case citations must be independently verified, and representatives must be able to confirm they have done so.
  • Para 1.6.5: refers to the judiciary's AI guidance for judicial office holders of 31 October 2025.
