The Brazilian Bar's first national guidance on generative AI, approved 11 November 2024 and prepared by its Cybersecurity, AI and Data Protection Observatory. Four pillars: applicable law including the LGPD, Statute and Code of Ethics; confidentiality and privacy; ethical legal practice with human supervision and verification; and prior formal communication to clients about AI use.

What the document requires

  • The lawyer must formalise to the client, before use, the intention to use AI in providing services.
  • Professional secrecy may not be compromised; no client data in AI systems without confidentiality and security guarantees.
  • AI output must be supervised and verified; responsibility stays with the lawyer.
  • Attention to algorithmic bias and to keeping up to date on AI implications.
