Part 161 applies to all New York Unified Court System courts in civil and criminal cases. Using an AI tool to prepare a paper is permitted and need not be disclosed, but the attorney or party must independently ensure it contains no fabricated cases, statutes or other material; signing certifies that review, and failure may draw sanctions.

What the document requires
- Applies to all UCS courts in both civil and criminal cases
- Defines AI as any machine-based system capable of making predictions, recommendations and/or decisions based on human-defined objectives and inputs
- Use of an AI tool to prepare a paper is permitted and need not be disclosed
- Any attorney or party who uses an AI tool must carefully review the paper and independently ensure it contains no fabricated or fictitious cases, statutes or other material
- Signing the paper certifies that such a review was conducted
- Failure to satisfy the requirement may result in sanction or other remedial action
