Guidance issued by the DIFC Courts on 21 December 2023 for parties and practitioners using large language models and generative AI in proceedings. It sets out four principles — transparency, accuracy and reliability, professional and legal obligations, and avoiding over-reliance — and requires parties to declare AI-generated content at the earliest possible opportunity.

What the document requires

  • All parties and the Courts should be made aware of any AI-generated content used during the process.
  • Parties must declare at the earliest opportunity that they have used or intend to use AI-generated content; late disclosure risks adjournment and lost trial dates.
  • AI-generated material must be verified for accuracy and reliability against independent sources such as case law and statutes before submission.
  • Practitioners must comply with the DIFC Courts Mandatory Code of Conduct and applicable data-protection and intellectual-property law.
  • Technology must assist submissions, not replace the integral human decision-making required.
  • Witness statements must remain in the intended witness's own words under RDC 29.24.
