What the document requires
- GenAI can produce fluent text containing factual errors or references to cases and statutes that do not exist; output must be critically reviewed before it enters advice.
- Advisory liability applies in full whether or not the advice rests on GenAI output (VRGA 5.3, 6.2).
- Professional secrecy holds regardless of working method; client information must not be used to train the model or generate output for other users.
- Client consent must be obtained where the tool's handling of information carries risks that contract terms and safeguards cannot address; standard terms are not sufficient.
- Under VRGA 7.6.2 firms should adopt, publish and regularly update GenAI policies and provide staff training scaled to actual use.
