Standing order of 2 April 2026 by Judge Wendy Berger (M.D. Fla.). Every filer must certify that no generative AI was used, or that a human reviewed any AI-drafted language for accuracy and that all citations are real and accurate. Non-compliant filings may be stricken; repeated failures risk dismissal with prejudice, default or referral.

What the document requires

  • Every filing must end with a certification that no generative AI was used, or that AI-drafted language (even if later edited) was personally reviewed by the filer or another human for accuracy.
  • Where AI was used, the certification must confirm that all legal citations reference actual cases or authority and accurately reflect their contents.
  • The AI certification does not count against page limits.
  • Non-compliant filings may be stricken without substantive consideration and without leave to amend.
  • Numerous failures to certify or to ensure the accuracy of AI-generated content will result in sanctions up to dismissal with prejudice, default and referral to the proper licensing authority; Rule 11 and 28 U.S.C. 1927 still apply.
