The Personal Injury Commission's direction, in force from 1 January 2026, applies the New South Wales model to workers compensation and motor accidents disputes and goes further in two respects: expert witnesses must disclose AI use, program and version and keep prompt records, and parties may not use AI technology during a hearing.

What the document requires

  • Gen AI must not generate the content of written statements; statements must disclose that Gen AI was not used to create their content.
  • Confidential, de-identified or legally privileged material must not be entered into a Gen AI program unless the platform is contractually closed and does not train on the data.
  • Where Gen AI assisted written submissions, the author must personally verify that all citations, authorities and legislative references exist and are accurate; verification may not be done with an AI tool.
  • Experts must disclose any Gen AI use, the program and version, how it was applied, and keep records of prompts or settings.
  • Parties must not use AI technology, including speech-to-text and transcription applications, during Commission hearings whether in person or virtual.
