Rule 3.G of the Montana Fourth Judicial District Court's Rules of Practice requires any party who used generative AI in preparing a filed document to disclose that use, name the tool, explain how it was used, and certify that AI-assisted portions have been checked for accuracy. A filing without the certification certifies that no AI was used.

What the document requires

  • Any party using generative AI to prepare a filed pleading or document must disclose the use, the specific tool and how it was used
  • The party must certify they have checked the accuracy of any AI-drafted or AI-assisted portion, including factual and procedural background, citations and legal authority
  • A filing without the certification is presumed to certify that no part was prepared using generative AI
  • Responsibility for content rests with the attorney or pro se litigant under Montana Rule of Civil Procedure 11 and the rules of professional conduct
  • Suspected violations may result in Rule 11 sanctions including dismissal of the party's case, document or pleading without prejudice
