Idaho's administrative judiciary adopted a near-total ban on adjudicative AI use. ALJs may not use AI to draft orders or decisions, to research law, or to summarise evidence and party submissions; limited transcript use is allowed; and ALJs may require parties to certify that AI-drafted content was checked by a human.

What the document requires

  • ALJs are not permitted to use AI or generative AI to write orders or decisions, at any stage of drafting including outlines
  • ALJs are not permitted to use AI or generative AI for legal research in case proceedings
  • ALJs are not permitted to use AI or generative AI to analyse or summarise evidence or party submissions, partly because uploaded data including PII may be retained for training
  • AI-generated voice-to-text transcripts from licensed non-retaining software are permitted but may not be cited; citations must be to the recording and verified
  • ALJs may request AI disclosure statements from represented and self-represented parties at their discretion, with recommended certification language
  • Governing canons: Idaho Code of Conduct for ALJs 1.2, 2.2 and 2.5
