Guidelines drafted by the Canadian Judicial Council's Technology Committee and published in September 2024 for federally appointed judges. They raise awareness of AI risks and set a principled framework for appropriate use: judicial independence, ethical use, safety, transparency, monitoring and continuing education. Judges retain exclusive responsibility for their decisions and may not delegate decision-making.

What the document requires

  • Judges hold exclusive responsibility for their decisions and are not permitted to delegate decision-making authority to AI.
  • Any AI use must preserve judicial independence and comply with the Ethical Principles for Judges.
  • Transparency, safety, monitoring of AI tools and continuing judicial education are required.
  • Published in both official languages and adopted or endorsed by several provincial courts.
