What the document requires

  • A lawful basis is required for personal data processing at every stage of an AI system's lifecycle, including model training.
  • Informed consent must disclose that data is being collected via an AI-based automated system.
  • Controllers must appoint DPOs, run data protection impact assessments and adopt written policies on generative AI use.
  • Unauthorised web scraping for AI training without consent is not permitted.
  • Data subject rights of access, correction and deletion apply and may require changes to the model.
