Guidance of 6 May 2024 from the conference of Germany's federal and state data protection authorities on using AI applications, in particular large language models, in compliance with data protection law. It is addressed primarily to controllers deploying AI and is the reference text the BRAK directs law firms to.

What the document requires
- Define the field of use and purpose, check its lawfulness, and prefer uses that need no personal data.
- No automated final decision: a human must take the decision (reflecting Art. 22 GDPR).
- Distinguish closed from open systems and be transparent about training use and prompt history, with a choice where possible.
- Carry out a data protection impact assessment, set internal rules, define and bind responsibility, and involve the DPO and staff representatives.
- Protect employees and set up business accounts rather than personal ones; apply privacy by design and by default.
