What the document requires

  • Classification: unacceptable risk (prohibited), high risk for critical sectors including healthcare, education, agriculture, finance, security, employment or public administration, limited risk and minimal risk; categories to be prescribed by the Cabinet Secretary on the Commissioner's recommendation.
  • Clause 26: high-risk providers and deployers must conduct a pre-deployment risk assessment with human oversight, a human rights impact assessment, ensure transparency, traceability and explainability, and keep records of inputs, training datasets and outputs for at least five years.
  • Clause 26(1)(g): systems generating or manipulating images, voice or likeness require explicit consent and clear AI-generated labelling.
  • Clause 28: automated decisions with significant legal effects must carry Data Protection Act safeguards including rights to human intervention, to express views and to contest; annual compliance reports go to the Commissioner.
  • Clause 27: a public register of high-risk AI systems, including those used by county governments.
