What the vendor documents
Recorded from the vendor's own trust, privacy and terms pages. "Not disclosed" means we found no public statement, not that the control is absent.
What the public documentation states
Litem's pages describe a litigation intelligence platform, formerly Deposely, covering document fact analysis, deposition preparation, real-time deposition insights, and drafting. The privacy policy, effective October 1, 2025, names Google Cloud AI as an example service provider. The MSA says Deposely will not train AI models using Customer Data, while the privacy policy separately lists improving the services, algorithms, and AI models as a commercial or business purpose for collecting Personal Data. The MSA states that outputs may not be error-free and customers must verify them. It also requires deletion of proprietary information after expiration or termination, subject to legal record-keeping requirements. The security page states SOC 2 Type II certification, HIPAA compliance, encryption at rest, and third-party penetration tests. ISO 27001, ISO 42001, data residency, private deployment, DPA, and a subprocessor list were not found. Pricing is set in an order form and renews for successive one-year periods; no list price is published.
In the vendor's words
“Deposely will not train artificial intelligence models using Customer Data as training materials.”
“Service Providers (e.g. Google Cloud AI)”
“The Services may contain Output that is not error-free”
“SOC 2 Type II-certified”
Not disclosed on public pages
"Not disclosed" records that no public statement was found where we looked, on the date shown. It does not assert that the control, term or figure is absent.
Not published on pages we read on 2026-09-06: DPA, subprocessor list, terms update date, data-residency locations, ISO 27001, ISO 42001, private deployment, zero-retention term, list price, free trial, seat minimum, and accuracy method. A law-firm procurement or DPIA review normally needs these points for client confidentiality, deposition transcript handling, SRA/ABA supervision, and GDPR Art. 28 processor terms.
Questions to put to the vendor
- Does the MSA no-training clause override the privacy policy purpose for improving algorithms and AI models when Customer Data contains Personal Data?
- Which Google Cloud AI services process transcripts, exhibits, or generated deposition outputs, and where?
- Can Deposely provide a DPA and subprocessor list for law-firm customer data?
- What deletion timetable applies to litigation materials after termination, including backups and legal record-keeping exceptions?
- What error-rate or review testing is used for Litem Facts, Litem Depositions, and Litem Agent?
