Denmark's national supplement to the EU AI Act, adopted 14 May 2025 and in force from 2 August 2025. It designates Digitaliseringsstyrelsen, Datatilsynet and Domstolsstyrelsen as national competent authorities, sets market surveillance powers, inspection rights and criminal penalties, and creates a bespoke split of supervision over courts' AI use.

What the document requires

  • § 2(1): Digitaliseringsstyrelsen, Datatilsynet and Domstolsstyrelsen are national competent authorities under Article 70(1) of the AI Act.
  • § 2(4): Domstolsstyrelsen is market surveillance authority for courts' use of AI systems when the courts are not acting in their capacity as a court.
  • § 2(5): where courts use AI in their judicial capacity, the relevant court decides, with appeal to a higher court within four weeks.
  • §§ 5–6: market surveillance authorities may demand information and enter business premises without a court order.
  • § 12: entry into force 2 August 2025.
